DESCRIPTION & RESPONSIBILITY

According to the Building Act 2004, Sections 362A to 363A protect the public during the reconstruction or alteration of an existing building that is open to the public. Section 363A allows public access and occupation of the building during construction and before a Code Compliance Certificate (CCC) is issued, provided a Council-issued Certificate of Public Use (CPU) is in place.

Section 363 states that a person who owns, occupies, or controls a building subject to Section 362A must not use, or permit the use of, any part of the premises affected by building work if: (1) a building consent has not been granted; (2) a building consent has been granted but does not have a CCC or CPU issued; or (3) a CPU has been issued but has not been complied with

1) Establish a meeting to discuss the project and receive advice
2) Agree upon terms between the Owner and AGENTNZ
3) Analyze the Building Consent documents
4) Utilize the guide for applying for a CPU
5) If constructing a new building, apply to a CPU to the Building Consent Authority
6) Undertake the final inspection and obtain documentation from other parties
7) Apply for a Code Compliance Certificate (CCC)
8) Follow up with the Building Consent Authority (BCA) for the CCC
9) Receive the CCC
10) Finalize the Service Agreement
